Firearm Law

Mr. Studer has been an active firearms advocate for most of his life, representing individuals in several hundred weapons cases. He has written gun trusts and advised on acquiring everything from shoulder-fired rockets to tanks. He is a Federal Firearms License (FFL) consultant, and he has worked extensively in matters involving the Second Amendment, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the National Firearms Act (NFA).

Along with his parents Joy and Jeff Studer, he has run a family business within the brokerage of Danberry Realtors for over five years, averaging more than forty real estate transactions per year. They are the only real estate agency in the area with an active attorney as part of the agency.

Gun Rights

Is there a waiting period to purchase a gun?

In the State of Ohio there is no waiting period. Per the Safer Community Act of June 2022 S(3)(b), if you are under the age of 21, a waiting period of up to ten days may apply.  

Do I have to get a background check?

Yes. Whenever you’re purchasing a firearm from an FFL, you have to get a background check through the FBI’s NICS system. This is completed during your purchase of the firearm from your registered FFL. You cannot fill-out the form before the purchase. 

Can I make a gun at home?

Yes, but this is an evolving area of the law. Historically, you could build your own firearms as long as they were for personal use only. But in the current political climate, there is no easy answer. You can, however, make ammunition. If you have further concerns, consider setting up a consultation with us.  

Do I have to register my gun?

No! There is no federal firearm registration process. Under federal and Ohio law, it is illegal to create a registry of firearms. See Ohio Revised Code 9.68, and 18 U.S.C. §926(a)(3). 

Can I buy a machine gun?

Yes, but this requires proper licensure and advanced background check forms, normally requiring you to submit fingerprints to the FBI and a more thorough background check process. Machine guns are a great investment opportunity, but a pricey one. The number of machine guns available for public transfer is limited, making them a fun and high value commodity.  

Can I buy a silencer?

A suppressor can be purchased with the proper licensure and advanced background check forms, following all the regulations of the National Firearms Act-Gun Control Act of 1968. Subsonic ammunition can be purchased without similar restrictions. 

What is concealed and constitutional carry?

Concealed carry entails going through a licensure process, including an 8-hour education course and a firearms handling and shooting section, which will provide you with a license to carry a concealed firearm in Ohio. As of 2022, Ohio has constitutional carry: anyone who is not a prohibited person can carry a handgun on or about their person “in a concealed fashion”. No license is required normally. However, a license will be honored in thirty-nine of the other States  

Can I keep a gun in my car?

A concealed carry license is required to keep a loaded handgun in your vehicle. Any other firearm must be unloaded, stowed or stored separately from the ammunition. It is illegal to transport a loaded firearm in a moving vehicle that is accessible to the passengers without leaving the vehicle. Can I carry a firearm at a bar?

Actually yes – if you’re not drinking. If you are drinking, it is a felony. Don’t do it! 

Can I give a gun as a gift or in a will? Can I give my child a gun?

As long as the transfer is to a person who can own a firearm – so no prohibited persons, and no one under eighteen. However, a firearm can be granted to a gun trust, which helps secure your intended grantees. This is a complex area of law, and we are happy to represent and inform you on it. What is a “prohibited person”?

Prohibited people, who cannot own firearms or ammunition, include people convicted of felonies or domestic abuse, subject to a protection order, dishonorably discharged from the armed forces, and more. What is an FFL / SOT ?

An FFL is a Federal Firearms Licensee, with a grant by the federal government permitting selling firearms to the public. It is heavily regulated by the ATF, and every purchase is subject to a background check in the FBI’s NICS system.  

What is a curio and relics license?

A curio or relics is a firearm manufactured at least fifty years ago, certified as a curio by the curator of a municipal, state, or federal museum, or any firearm which derives most of its monetary value from its novel or rare nature, and/or association with a historical figure or event. A curio and relic license permits the holder to purchase these firearms and have them shipped directly to their front door.
